In Connecticut, a legal
separation is like a divorce in that the same procedure
applies and the same types of final orders are
entered. The only difference is that at the end of
the process the parties remain legally married.
Legal separations are not very
common. People who follow religious beliefs that do
not allow divorce may choose a legal separation.
People who want to remain on a family health insurance
plan may also choose a legal separation. However,
many health insurance companies treat legal separation the
same as divorce and will terminate benefits.
If the parties start
living together again as husband and wife after final
orders are entered for a legal separation, they may cancel
the orders by filing a notarized and witnessed statement
with a divorce court.
If the final orders have not
been canceled, either party may go to divorce court at any
time and convert the legal separation into a divorce.
